1. Can a man win a divorce case?

Yes. Indian family courts don’t decide based on gender. If a husband proves legal grounds (or both parties mutually consent), he can get a divorce and appropriate orders on custody, maintenance, and property.

2. Can we get a divorce in 15 days?

In most Indian cases, no. For mutual consent divorce under the Hindu Marriage Act, couples must usually have lived separately for at least 1 year, and the law provides a minimum 6-month gap between the first and second motion. Courts can waive the 6-month cooling-off period in certain situations (it’s discretionary, not automatic). What this really means is: 15 days is extremely unlikely unless it’s a very exceptional, fast-tracked situation.

5. Who pays the fees in a divorce?

Typically: Each spouse pays their own lawyer’s fees. Court fees are usually paid by the party filing, or shared in mutual consent. Courts can also order costs to be paid by one party in some cases (depends on conduct, proceedings, and orders).
